Welcome to Trend Digital! By using our services, you agree to abide by these Terms and Conditions. Please review them carefully to understand your rights, obligations, and any fees associated with your account.

 
1. Account Registration and Information
Users must provide accurate and complete information during account registration. You are responsible for keeping your account credentials secure and confidential. Any account misuse, unauthorized access, or breach of security must be reported immediately to TREND.

 
2. Ownership of Content
All content created by TREND, including but not limited to marketing materials, ads, copy, CRM setups, AI integrations, and other deliverables, remains the intellectual property of TREND unless otherwise agreed upon in writing.

 
3. Usage of TREND Services
Users agree to use TREND services in an ethical and legal manner. You may not use our services for illegal activities, unauthorized purposes, or unethical marketing practices (e.g., spamming). Misuse of the platform may result in immediate termination of your account without prior notice.

 
4. Payment Terms and Structure

DIY Plans:
$97/month for CRM Only
$197/month for CRM & AdMax
$297/month for CRM, AdMax, and 1 AI Live Bot (additional bots billed at $97 each)

DFY Plans:
$497-$4,997 one-time setup fee
$497/month for advertising on one platform
$997/month for advertising on two platforms
$1997/month for advertising on three or more platforms

For clients with ad spend over $5,000, the payment structure shifts to a 20% commission on total ad spend, with no monthly retainer.

Late Fee Policy:
Invoices are due as per the agreed schedule.A $50 flat fee will be charged for any payments made after the due date.
A 7-day grace period is provided after the due date before the late fee is applied.
The maximum late fee per invoice will not exceed $300.
The late fee is only applied once after the grace period ends.
Automated email reminders will be sent 3 days before the due date, on the due date, and after the grace period ends.
 
5. CRM and Usage Fees
All usage fees, such as SMS, email, and other communications through TREND, are billed separately based on the following rates:

Email
$0.001 per email sent
Example: $10 covers approximately 10,000 emails.

SMS (Text Messages)
$0.0119 per SMS segment
Example: $10 covers approximately 840 SMS segments.

Calls (Outbound & Inbound)
Outbound Calls: $0.021 per minute
Inbound Calls: $0.0128 per minute
Example: $10 allows approximately 475 outbound or 780 inbound minutes.

Premium Triggers & Actions (Workflows)
$0.015 per premium action
Example: $10 covers approximately 665 premium workflow actions.

Email Verification
$0.0037 per verification
Example: $10 covers approximately 2,705 email verifications.

Content AI
$0.0945 per 1,000 words or $0.063 per image
Example: $10 generates approximately 105,820 words or 160 images.

Workflow AI
GPT-4 Executions: $0.0315 per execution
GPT-3.5 Executions: $0.0158 per execution Example: $10 covers approximately 315 GPT-4 executions or 635 GPT-3.5 executions.

Conversation AI (Chatbots)
$0.03 per message
Example: $10 covers approximately 335 chatbot messages.

WhatsApp Conversations
$0.0777 per conversation
Example: $10 covers approximately 130 WhatsApp conversations.
Review Responses (Reviews AI)
$0.12 per review response
Example: $10 covers approximately 85 review responses.

Twilio Number & Usage:
Twilio setup fees are billed separately. Usage fees for Twilio services (e.g., SMS, phone numbers) will be charged based on actual use and invoiced monthly. These fees ensure transparent billing for all SMS campaigns and phone interactions managed through Trend Hub. *Average* phone line cost $2.25 per month.

 
6. Modifications to Terms
TREND reserves the right to modify these terms and conditions at any time. Users will be notified of significant changes, but continued use of our services implies acceptance of the updated terms.

 
7. Service Termination
Users may terminate their account at any time by providing a 30-day written notice.

Upon cancellation: Services will cease at the end of the current billing cycle.
Access to the TREND Digital portal (https://scale.trend.gg/login) will be revoked unless otherwise agreed.
No refunds will be provided for services already rendered.
TREND reserves the right to terminate accounts for breach of terms or unethical practices, without issuing a refund.

 
8. Refunds and Revisions
TREND does not provide refunds for services already rendered. Two rounds of revisions are included for any creative work or campaigns. Additional revisions will be billed at $150 per hour.

 
9. Pricing Adjustments
TREND reserves the right to adjust pricing for services, setup fees, and usage costs with prior notice to affected users. Pricing changes will not affect services already rendered or previously agreed-upon contracts.

 
10. Liability
TREND is not liable for unforeseen circumstances resulting from changes to third-party platforms (e.g., Meta, Google Ads). Users are responsible for complying with the terms of third-party platforms when using TREND’s services in conjunction with these platforms.

 
11. Data Security and Privacy
TREND takes data security seriously and uses the secure ChatGPT API for all AI-driven services to ensure data confidentiality. Users are responsible for handling all sensitive customer information in compliance with applicable laws and regulations.
